Justice Murray accepts OAG-led agreements forged in Nordic fish factory case
Yesterday, Waldo County Superior Court Justice Robert Murray formally accepted three negotiated agreements between parties in the 2019 case against Nordic Aquafarms. The agreement – or “stipulations” – confirm that the City of Belfast cannot ignore the legal process of amending or terminating a conservation easement.
Murray’s March 2 order does three things:
(1) upholds the Office of Attorney General’s (OAG) compliant that Belfast cannot unilaterally amend or terminate a valid conservation easement;
(2) dismisses the OAG’s second complaint against Belfast; and
(3) dismisses Belfast’s counterclaim against the OAG.
Tuesday’s order puts to rest Belfast’s attempt to condemn our conservation easement with Jeffrey Mabee and Judith Grace.
In a separate but related action, Justice Murray will hear oral arguments on certain elements of the ownership controversy at 1:00 p.m. today. via Zoom teleconference.
